1st Subject matter of the conditions

The following conditions govern the use of the satellite-based nomadic broadband service IPcopter Pro from IPcopter GmbH & Co. KG (hereinafter referred to as IPcopter) by customers within the coverage area designated on www.ipcopter.de.

1.1 IPcopter Pro
IPcopter Pro allows the customer access to the Internet at any location within the coverage area. For this purpose, the service classes www.pro and www.standard are available to the customer.

1.2 Customer Requirements
To use IPcopter Pro, the customer side requires the Alden @ system, consisting of the self-aligning outdoor unit, the antenna controller and the satellite modem as the indoor unit. Furthermore, a PC or laptop with a suitable operating system, web browser and corresponding IP network protocol is required for use.

1.3 Security
Data transmission over IPcopter's satellite communications network is encrypted. Nevertheless, the data may possibly be viewed by third parties. A further securing of the data transfer can only take place through an application to be implemented by the customer.

1.4 Content Responsibility
The customer is responsible for the content which he retrieves via IPcopter pro, or which is distributed in any way, to IPcopter and third parties. The contents are not subject to review by IPcopter.

IPcopter provides the following services within the existing IPcopter pro service and operational capabilities:

2nd Services provided by IPcopter

2.1 Access to the Internet
IPcopter enables the customer via IPcopter Pro to access the Internet via the IPcopter satellite communications network. The satellite communication network establishes data transmission between the Internet and the customer's terminal. For this, the customer must establish a connection from his terminal to the satellite modem. The transmission speed during use is u. a. depends on the network load of the Internet backbone, on the transmission speed of the selected servers of the respective content provider, on the number of users in the IPcopter network, on the service profile selected by the customer and on the data transfer assurance procedure implemented by the customer. If there is no data traffic for more than 5 minutes, the connection is automatically interrupted by IPcopter.

2.2 Authorization
The access authorization is based on the satellite modem. With the purchase of the Alden @ system the customer acquires an initial access authorization. The customer undertakes to register with IPcopter as part of the initial access. Registration takes place online on the IPcopter portal. The registration allows the customer to monitor his access account and to purchase further access subscriptions.

2.3 Supply area
The IPcopter pro access is possible within the coverage of the F2 beam of the Hellas Sat satellite, see https://www.ipcopter.com//en/company /satellite_beam.php

2.4 Service
IPcopter receives customer incident reports on weekdays from 9:00 am to 6:00 pm and immediately eliminates disruptions to their technical equipment as part of their technical and operational capabilities.

3rd Duties and Obligations of the Customer

3.1 The customer has in particular the following obligations:
a) The agreed prices must be paid on time according to the price list and the associated terms of payment. For any unpaid check or any non-cashed or returned direct debit, the customer shall reimburse IPcopter for the costs incurred to the extent that it is responsible for the event causing the costs.
b) After submitting a fault report, the IPcopter should be reimbursed for expenses incurred by checking their technical equipment if there was no fault in the technical equipment of IPcopter and the customer could have recognized this with reasonable troubleshooting.
c) The services must not be misused, in particular - the unsolicited sending of messages or information to third parties for advertising purposes (spamming) should be avoided.

  • these are not for attempts to unauthorized retrieval of information and data or
    to use unauthorized intrusion into data networks.
  • must not have any executable routines (such as spyware, dialers, etc.) automatically, unauthorized
    and hidden on computers to be transferred to the Internet users.

d) No information with legal or immoral content may be distributed. In particular, this includes information that serves the purpose of sedition within the meaning of §§ 130, 130a and 131 StGB, or glorify or downplay violence, are sexually offensive, pornographic in the sense of § 184 StGB are suitable, children or adolescents morally difficult to endanger or interfere with their welfare or damage the reputation of IPcopter.
e) It is up to the customer to make a special security configuration of his software so that the data transmission is protected against access by third parties. IPcopter points out that these security configurations can result in reduced transmission speeds.
f) A connection to the Internet must always be terminated by the customer by leaving the access application (Internet browser such as internet Explorer, Firefox). If a connection has otherwise been terminated, such as in the case of an automatic interruption pursuant to item 2.1, the customer should switch off the terminal to ensure that no unintentional connections are made to the Internet and thus unwanted user charges are incurred.
g) IPcopter and its vicarious agents are to be exempted from all claims of third parties based on or with the approval of IPcopter Pro and the associated services in accordance with the General Terms and Conditions, as of August 2007, or the arising in particular from data protection, copyright or other legal disputes connected with the use of IPcopter Pro. If the customer recognizes or has to recognize that such a breach is imminent, there is a duty to inform IPcopter immediately.

3.2 If the customer violates his obligations

  • in particular the obligations listed under point 3.1 (c) (d)

Significant and sustainable and he does not undo this breach of contract in spite of a warning, IPcopter is entitled to block access to the IPcopter satellite communication network at the expense of the customer. In this case, the customer remains obliged to pay the monthly prices or has no right to recovery of prepaid usage fees. If the conditions for extraordinary termination are met, IPcopter is entitled to block it without prior warning.

4th Use by third parties

4.1 The customer is not permitted to make the assigned access rights available to third parties for use. Furthermore, the customer is not permitted to make services of IPcopter pro commercially or otherwise available for payment to third parties for use.
4.2 The access rights granted to the customer for the use of IPcopter, in particular the personal password, must be protected against access by third parties.
4.3 The customer must also pay the prices that have been incurred by unauthorized use of IPcopter Pro by other third parties, if and to the extent that the customer is responsible for this use.

5th Payment Terms

5.1 The initial access authorization is included in the total price of the Alden @ system
5.2 When booking via the online booking portal, the prices for daily packages according to the price list are https: /www.ipcopter.com/en/shop/ in advance to pay. The customer will receive the corresponding invoice from IPcopter via e-mail.
5.3 Tariff Day Packages: The validity of each day pack is shown in the current price list, https://www.ipcopter.com/en/shop/ , The day of use is the calendar day on which the customer used the Internet. The day of use is also the calendar day on which the Alden @ system is switched on for longer than two hours and thus in
the network is involved. Accidental short-term switching on of the system without Internet use does not lead to the deduction of a day of use.
5.4 Pricing for longer term use of IPcopter pro is payable as a monthly fee before provision of the service, see price list https://www.ipcopter.com/en/ shop /
5.5 In the case of 5.3, the invoice amount must be paid to the account specified in the invoice, and must be credited no later than the tenth day after receipt of the invoice. In the case of a debit authorization issued by the customer, IPcopter will debit the invoice amount from the agreed account.

6th Exclusion of complaints

Complaints against the invoice must be made immediately after receipt by IPcopter in writing. Complaints must be received by IPcopter within eight weeks of receipt of invoice. The omission of timely complaints is considered approval; IPcopter will point out in the invoices the consequences of an omitted timely complaint. Statutory claims of the customer in the case of complaints after expiry of the deadline remain unaffected.

7th Changes in prices, service descriptions and terms and conditions

7.1. For price increases and other changes to the detriment of the customer, the customer may terminate the contract at the time the change takes effect. IPcopter will particularly point out this special right of termination in the letter of notification. The termination must be received within six weeks after receipt of the notice.
7.2 If IPcopter intends any other price changes, changes to the General Terms and Conditions or the service description, the change proposal will be communicated to the customer in writing. The changes are considered approved if the customer does not object to them in writing. IPcopter will particularly point out this episode in the letter of notification. The objection must be received within six weeks of receipt of the notification. If the customer exercises his right of objection, the change request of IPcopter shall be deemed rejected. The contract will then continue without the proposed changes. The right of the contracting parties to terminate the contract remains unaffected.

8th Delay (except "daily packages" tariffs)

8.1 In the event of late payment, IPcopter is entitled to block the services at the expense of the customer. In this case, the customer remains obliged to pay the monthly prices.
8.2 Comes the customer
a) for two consecutive months, with the payment of the prices or a significant part of the prices; or b) in a period of more than two months, with the payment of the prices in the amount of an amount, If the monthly price for two months is reached, IPcopter can terminate the contractual relationship without notice.
8.3 The assertion of further claims for default of payment remains reserved for IPcopter.
8.4 Device IPcopter is in default with the owed service, the customer is only then entitled to withdraw from the contract if IPcopter does not comply with a reasonable additional period set by the customer, which must be at least two weeks.

9th Termination (except Day Packages)

9.1 The contractual relationship can be terminated by both parties at the end of each calendar month. The termination must be received in writing by IPcopter or the customer at least six working days before the date on which it is to become effective. Saturday does not count as workday. Upon termination by the customer of prepaid services, the latter has no claim for repayment of services not provided.
9.2 The right to terminate for good cause remains unaffected.

10th Severability clause

Should a provision of this agreement be wholly or partially ineffective or lose its legal validity later, this shall not affect the validity of the remaining provisions. In place of the ineffective provision the legal regulations apply.

11th Other conditions

11.1 The Customer may transfer the rights and obligations under this Agreement to a third party only with the prior written consent of IPcopter (does not apply to the "Daily Package" tariff).
11.2 The provisions of the Product Liability Act remain unaffected.
11.3 German law applies to the contractual relationships of the contractual partners.
